  1. Application

These Terms and Conditions apply to the rental of guest rooms at Villa Shanthi for accommodation and to all other services and supplies rendered to the guest by Villa Shanthi. By making a booking request the guest accepts and agrees that the rental contract entered into with Villa Shanthi by reservation confirmation shall be based on these Terms and Conditions without exception.

  1. Booking and Payment

When the guest makes a booking request, the guest receives a reservation confirmation, which will only be valid if the guest pays a deposit of 25% of the total rental amount immediately. If the deposit is not received within 10 days of reservation confirmation, Villa Shanthi reserves the right to void the booking. The remaining 75% of the total rental amount is to be paid without further notice no less than 30 days before the scheduled arrival. For bookings within 30 days before the arrival the total rental amount (100%) is due immediately. If payments are not made by the due dates as required herein Villa Shanthi may cancel the booking without any further notice required. Cancellation charges may apply as detailed below. Special agreements are only effective if they are confirmed in writing in the reservation / booking confirmation of Villa Shanthi. Any bank or credit card transfer costs are to be paid by the guest.

  1. Cancellation

If a guest wishes to cancel a confirmed booking, written notice of cancellation must be sent to Villa Shanthi. All cancellation notices received by Villa Shanthi will be acknowledged in writing. It is strongly recommended to purchase travel cancellation insurance. In the event of the cancellation of the booking, no-show or early departure by the guest, a cancellation fee will need to be paid by the guest. The following cancellation fees will apply:

  • Less than 14 days before arrival / in the event of no show:     100% of the total rental amount
  • In the event of early departure:                                                    100% of the remaining rental amount.

The applicable amount will be deducted from the deposit and moneys paid, and Villa Shanthi will refund any remaining balance to the guest.

  1. Security deposit

A security deposit might by requested to be paid for every rental at check-in and will be communicated by Villa Shanthi at the booking. The guest is required to inform the villa management of any serious damage or breakages caused during your stay immediately. Anything damaged, spoilt or broken will be charged at the replacement cost. In the event the property or its belongings, fixtures or fittings are damaged/broken in any way then charges will be deducted from the security deposit, otherwise the security deposit will be fully refunded.

  1. Complaints

Every attempt will be made for the guest to have an enjoyable stay. If the guest should have a problem during the rental period, please inform the Villa Manager immediately who will endeavor to put things right. If no complaint is reported during the rental period, Villa Shanthi will assume that the property was to the guest’s satisfaction and no complaint will be put forward.

  1. Liabilities / Disclaimer

Villa Shanthi does not accept any responsibility and is not liable for damages arising from physical injury to life, limb or health unless caused by intent or gross negligence on the part of Villa Shanthi, its employees or representatives. The guest is required to take due care and act responsibly and courteous during the stay at Villa Shanthi. Children MUST be under supervision of an adult at all times when staying at the Villa. Damage or injury arising as a result shall not be the responsibility of Villa Shanthi. Villa Shanthi does not accept any responsibility and is not liable for the loss of or damage to the guest’s property and valuables unless caused by intent or gross negligence on the part of Villa Shanthi, its employees or representatives. The guest is responsible for the valuables or property during the rental period, and must ensure that all windows and doors are locked securely when not on the premises. Each guest room has a safe where cash and valuables can be stored during the rental period. Villa Shanthi recommends that the guest utilizes this possibility. Items left at a property will be returned only upon request and at the guest’s expense. Villa Shanthi will only hold items for up to 6 months before they are discarded. Villa Shanthi does not accept any responsibility and is not liable for the inability of the guest to arrive or to stay at Villa Shanthi for all or part of the rental period as a result of failure to obtain appropriate travel or visa documentation, cancellation or amendments to travel arrangements or the missing of flights or travel connections; for the delay or cancellation of the booking as a result of war, threat of war, riot or civil strife, strike, demonstration, terrorist activity (threatened or actual), natural disaster, fire, sickness, weather conditions, action at an airport or port by any government or public authority, technical problems relating to transport and airport regulations caused by technical, mechanical or electrical breakdowns, or any other circumstances which amount to ‘force majeure’ or other events beyond Villa Shanthi’s control. Villa Shanthi does not accept any liability for any temporary defect or stoppage in the supply of public services to the property, such as water, electricity, gas, telephone or Internet, or in respect of any equipment, machinery or appliances in the property or the garden. The guest is obliged to contribute reasonably to keep away and eliminate any possible disruption or damage. In the possible event of an emergency or damage, the guest is required to report this to the villa management immediately. The guest is liable for all damages to the property or its belongings, fixtures or fittings or furniture caused by the guest or the guest’s party and the costs will be deducted from the security deposit paid at the check-in. Should the security deposit not cover all the damage, repair or replacement caused, Villa Shanthi has the right to request extra funds to make up the difference. If guest’s behavior is found to be unacceptable, Villa Shanthi has the right to terminate the rental immediately and no refund will be due.

  1. Immigration / Documentation

The guest is responsible for compliance with all immigration requirements applicable, in particular all passport, visa and customs requirements as well as health (including possible vaccination).

  1. Arrival – Departure

On the agreed day of arrival, the guest room will be available from 2 pm. The guest is not entitled to the provision of a specific room, unless Villa Shanthi has confirmed otherwise in written form. On the agreed date of departure, the guest room shall be vacated and at Villa Shanthi’s free disposal by 11 am. For rooms not vacated by then, Villa Shanthi is entitled to charge the daily room rate for the additional use of the room.

  1. Jurisdiction / Final Provisions

These Terms and Conditions are governed by the laws of the Federal Republic of Germany. In the event of controversy arising from the booking and the rental that cannot be resolved amicably between the parties, both parties agree to exclusively refer the matter to the German court of Dresden. In case of doubts or questions as to the interpretation of these bilingual General Terms und Conditions, the German version shall be decisive. If any of the Terms and Conditions become or are deemed to be invalid, or if there is any omission from the Terms and Conditions, the remaining Terms and Conditions will remain valid and enforceable and cannot be contested.
